Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that, for the most part, can neither be attributed to their commercial nor their independent professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

  • on which you or a third party named by you, who is not the carrier, have taken possession of the goods, provided you ordered one or more goods as part of a single order and they are delivered uniformly;

  • on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, provided you ordered several goods as part of a single order and they are delivered separately;

  • on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or item, provided you ordered a good that is delivered in multiple partial shipments or items;

To exercise your right of withdrawal, you must inform us (ADEMs GmbH, Obere Hauptstraße 19, 68766 Hockenheim, Phone number: +49 1514 4031652, Email address: shop@adembogoceli.music) of your decision to withdraw from this contract by means of a clear declaration (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, although this is not mandatory.

You can also exercise your right of withdrawal online by clicking on a designated button ("Cancel Order", "Withdraw from Contract", or similar wording) on our website (shop.adembogoceli.com). If you use this online function, we will send you a confirmation of receipt containing details regarding the content of your declaration of withdrawal, as well as the date and time of its receipt, on a durable medium (e.g., via email) without delay.

To meet the withdrawal deadline, it is sufficient for you to send the notification concerning your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), immediately and at the latest within 14 days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must send back or hand over the goods to us immediately and in any event no later than 14 days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send off the goods before the period of 14 days expires.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exceptions and Early Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts for:

  • the delivery of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;

  • the delivery of goods that can spoil quickly or whose expiration date would be exceeded quickly;

  • the delivery of alcoholic beverages, the price of which was agreed upon at the time of concluding the contract, but which can be delivered at the earliest 30 days after the conclusion of the contract and whose current value depends on market fluctuations over which the trader has no influence;

  • the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts concerning:

  • the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery;

  • the delivery of goods if, after delivery, they were inextricably mixed with other goods due to their nature;

  • the delivery of audio or video recordings or computer software in a sealed package if the seal was removed after delivery.
